AUSTIN - State Rep. Ryan Guillen (D-Rural South Texas) filed a bill this legislative session to require used car dealers to complete a dealer education course approved by the Texas Department of Motor Vehicles.   

"Every year, thousands of families choose to make their vehicle purchases at used car dealers," said Guillen. "But too often, these dealers go bankrupt and these families are unable to get releases of lien or clear titles."                      


Approximately, 3,000 used car dealers go out of business each year in Texas ­­­­— nearly one third of the entire dealer population. Dealers are often unaware of obligations they must still fulfill before their bankruptcy, leaving many families unable to obtain proper financial documentation.

HB 4405 would require every used car dealership applicant to submit to the Department of Motor Vehicles a proof of completion of a dealer education course. The course must be approved by the Department and must include instruction in federal and state laws and Department rules for used car dealers.

"Families trust dealers with one of the biggest decisions of their lives," added Guillen. "The state should ensure that the dealers know their obligations and fulfill them."
